1. Agreement

These Terms of Service ("Terms") govern your access to and use of the Call Kudu website at callkudu.co.za, the Call Kudu application at app.callkudu.co.za, and related services (collectively, the "Service"). The Service is provided by Paradise Node (Pty) Ltd ("Call Kudu", "we", "us", or "our").

By accessing or using the Service, submitting a pilot sign-up form, or creating an account, you agree to these Terms. If you do not agree, do not use the Service.

2. The Service

Call Kudu is an AI-powered phone assistant that helps businesses answer incoming calls, respond to common questions, and capture bookings. Features may include call handling, voice automation, transcripts, recordings, calendar integration, and a business dashboard.

We may update, modify, suspend, or discontinue any part of the Service at any time. Pilot programme access, pricing, and features may change without notice.

3. Eligibility and accounts

The Service is intended for businesses and authorised representatives acting on their behalf. You must provide accurate information when registering or submitting a pilot enquiry and keep your account details up to date.

You are responsible for safeguarding login credentials and for all activity under your account, including actions taken by team members and automated configurations you enable.

4. Acceptable use

You agree to use Call Kudu only for lawful business purposes and in compliance with all applicable laws, including telecommunications, consumer protection, and data protection laws in South Africa.

If you use Call Kudu to communicate with your customers or callers, you remain solely responsible for those communications, your business practices, booking policies, pricing disclosures, and compliance with applicable regulations.

You are responsible for obtaining any consents or providing any notices required for call recording, automated call handling, or processing of personal information, including under POPIA.

6. Call Transcription and Recording

Calls handled through Call Kudu are transcribed for service functionality, analytics, and quality improvement. Calls may also be recorded depending on your configuration and service routing.

You are responsible for deciding whether transcription and recording are appropriate for your business and for ensuring compliance with all applicable laws, regulations, and any required caller notice or consent obligations in your jurisdiction.

7. AI-generated responses

Call Kudu uses artificial intelligence to interpret and respond to callers. AI outputs may be incomplete, inaccurate, or unsuitable for a particular situation. You are responsible for reviewing assistant configuration, monitoring interactions where appropriate, and ensuring the Service meets your business needs.

The Service is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted availability, error-free operation, or that AI responses will always be accurate or appropriate.

8. Pilot programme

If you sign up for a pilot programme through this website, submission of your interest does not guarantee acceptance. Pilot access may be limited, free of charge for a defined period, and subject to separate communication from our team.

We may modify or end pilot access at any time.

9. Fees and payment

Paid subscriptions, if applicable, are billed according to the plan selected in the application. Fees, billing cycles, and cancellation terms will be presented at the point of purchase or in your account. Failure to pay may result in suspension or termination of access.

10. Intellectual property

Call Kudu, including its software, branding, website content, and documentation, is owned by or licensed to Paradise Node (Pty) Ltd. Except as expressly permitted, you may not copy, modify, distribute, or create derivative works from the Service.

You retain ownership of content you provide. You grant us a limited licence to use that content solely to operate and improve the Service on your behalf.

11. Privacy

Our collection and use of personal information is described in our Privacy Policy, which forms part of these Terms.

12. Suspension and termination

We may suspend or terminate access to the Service immediately if we reasonably believe you have breached these Terms, misused the platform, or created legal, security, or operational risk.

We may also report activity to relevant authorities where misuse, abuse, or unlawful behaviour is suspected. You may stop using the Service at any time. Provisions that by their nature should survive termination will continue to apply.

13. Disclaimer of warranties

To the fullest extent permitted by applicable law, Call Kudu and Paradise Node (Pty) Ltd disclaim all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

14. Limitation of liability

To the fullest extent permitted by applicable law, Call Kudu and Paradise Node (Pty) Ltd shall not be liable for any indirect, incidental, consequential, special, or exemplary damages, including loss of profits, data, business opportunity, or goodwill, arising from or related to your use of the Service.

Our total liability for any claim arising out of or relating to the Service shall not exceed the amount paid by you to Call Kudu for the Service in the twelve (12) months preceding the event giving rise to the claim, or ZAR 1,000 if no fees were paid, whichever is greater.

15. Indemnity

You agree to indemnify and hold Call Kudu and Paradise Node (Pty) Ltd harmless against claims, losses, liabilities, damages, and costs (including reasonable legal fees) arising from your use of the Service, your customer communications, your breach of these Terms, or your violation of applicable law.

16. Governing law

These Terms are governed by the laws of the Republic of South Africa. Subject to any mandatory rights you may have under applicable law, the courts of South Africa shall have jurisdiction over disputes arising from these Terms or the Service.

17. Changes

We may update these Terms from time to time. The effective date at the top of this page indicates when they were last revised. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
